William Leverich, from whom however the Court of Assize, sitting in New York, Oct. 22, 1670, granted (her) Rebecca Leveridge a divorce from her husband Eleazer, on account of "his alleged impotency after they had been married seven and a half years past, and due examination of the matter by surgeons well skilled in the matter and sober matrons, who privately examined both the man and the woman" And an order being made the 24 Feb. 1670/1 it was decided that "Eleazor Leverich do pay, or cause to be paid unto Rebecca Wright, from whom he is divorced, the sum of £25, in living cattle, to be apprizedby indifferent men, or in corne, beef for pork, at price durrent, in lieu of what she brought him at their marriage."

      …Eleazer Leverich, was a son of Rev. William Leverich, one of the three original grantees named in the Indian deed of 1653. In March 1669-70, Rebecca Leverich, as she then was, applied to Governor Lovelace, for a divorce from Eleazer Leverich, on the ground of alleged impotency, after they had been married seven and one-half years.
      The full records of this proceeding are set forth at length in 'Minutes of the Executive Council of the Province of New York, Paltsits, Albany. 1910, Vol. I, p. 331, et seq., and although the record is long, it is interesting enough to be given here in full:
      "Mr. (Jonas) Wood
      I have recd a Peticon from Rebecka ye wife of Eleazer Leveredge of yor Towne by ye hands of her father Nicholas Wright of wch I send you a Copy. The occasion therof being well Knowne to you (as I am informed) I shall desire you to Acquaint me in Wryting what hath already past concerning this matter in difference betweene ye husband & wife wth what you can make further Inquiry of touching ye same, & retorne me a speedy Acct thereof Togethr yor opinion of ye whole Case Whereupon I shall endevour to proceed in decision of ye matter according to Law & good Consience, This is all at present from

      "An Ordr for ye hearing ye matter in difference betweene Eleazer Leveridge of Huntington, and his wife Rebecka, at a Speciall Court to be houlden in this City.
      Whereas Nicholas Wright of Oysterbay, hath on ye behalfe of Rebeckah his daughtr, wife of Eleazer Leveridg, of Huntington, made Complaint unto me of ye uncomfortable condition wherein his said Daughter hath for divers yeares past lived wth her said husband, & there having beene formerly severall Complaints made both on ye parte of ye Relations of ye husband, as well as those of ye wife, suggesting some notorious fault of impediment on ye one side, or ye other, weh hitherto hath not beene fully or clearely made appeare, so that their mutuall discords, & differences doe still continue, To ye end a faire Composure of ye same may be effected, or some other Lawfull course taken therein, I have by & with ye advice & consent of my Councill thought fitt to ordr & appoint & by theise presents do ordr & appoint that Eleazer Leveridg, & Rebeckah his wife, doe appeare here in this Citty, upon Wednesday ye fourth day of May next, before a speciall Court then appointed to Examyne into & determine ye matter in difference betweene them, & all persons concerned, or that can give in evidence on either parte are likewise hereby required to make their appearance before ye said Court for ye better clearing of ye truth, so that ye controversy may be decided according to Law & good conscience.

      "A Commission graunted to Mr. Thomas Lovelace & othrs to inquire into ye mattr betweene Eleazer Leveridge, & Rebecka his wife.
      Whereas Complaint hath been made unto me by Nicholas Wright on ye behalfe of Rebeckah his daughtr agt Eleazer Leveridge her husband, & also by ye said Rebeckah against him, ye said Eleazer, that having been joined in matrimonye for ye space of seaven yeares & a halfe, or thereabouts, he ye said husband hath not performed Conjugall Rights unto his wife, but on ye contrary hath caused her to lead a very uncomfortable life wth him, And the said ffather & daughtr upon supposition of Impotency & insufficiency in ye said Eleazer Leveridg, having sued for divorce, the hearing & examinacon into wch mattr I do not judg meet should come befor a publique Court, I have therefore thought fitt to nominate & appoint, & by theise presents do hereby nominate & appoint you Thomas Lovelace, Esqr; Mr Samnell Maverick; Mr Matthias Nicolls; Captn John Manning, & Mr Humphrey Davenport to be Comrs to meet at some Convienient place this afternoon then & there to heare & Examyn into this matter in difference betweene ye said Eleazer Leveredge, & Rebeckah his wife, To wch End you are to call both ye parties before you, or whosoever else can Give Evidence or Testimonye in ye matter, To whome you may administer an Oath for ye better clearing of ye truth, wch Oath you are herby Empowered to give, as also to Employ any other person or persons skilfull in such matters to make inquiry into ye defect & impediments alleadged, whereupon you are to give yor judgmts, & render me an Account thereof that I may make some finall determination thereupon. Given under my hand & seale this 6th day of May in the 22nd yeare of his Majesties Raigne,

      "The Governors Instructions to ye Comrs appointed to inquire into ye matter betweene Eliezer Leveridge, & Rebecka his wife. Whereas a certaine Petition was presented to me from Rebecka Leveredg, wife to Eliazer Leveredg of Huntington, Complayning that she being his reputed wife for ye space of seaven yeares & a halfe, hath in all that tyme received no due benevolence from ye said Eleazer according to ye true intention of matrimony, The great end of wch is not onely to Extinguish those Fleshly desires & appetites incident to humane nature, but likewise for ye well ordering & confirmacon of the Right of meum & tuum to be devolved upon ye Posterity lawfully begotten betwixt man & wife according to ye Lawes of ye Land & practise of all Christian Nations, in that Case provided, I have therefore thought fitt (for son reasons me thereunto moving) not to assume ye Examynacon of ye Case of Impotence into my hand, but referr ye debates of that to such persons as by a Comession, under my hand & seale, I shall authorize fully to heare that matter, & make a Report thereof to me, who thereupon will give in my determination, as Justice of ye Cause shall merit, And for ye future Execution of ye said Comon I give theise further directions.
      First, in regard ye prayer of ye Petition implies a divorce (for ye reasons alleadged therein) you are principally to inquire whether they are man & wife according to ye Lawes & proctise of that Governmt that was Establis'ht over them.
      Secondly, if it shall appeare to you to ye contrary, that then ye partyes be bound over ye next Sessions, there to answer their Contempt & breach of ye Law. But if it shall appeare before you that they were lawfully espoused to each othr according to the Law in that Case provided, that then you enter into ye debate & determination of ye insufficiency alleadged by Rebeckah Leveredg wife to Eleazer her reputed husband as is alleadged in that Petition concerning his sufficiency for procreation, ye true end of matrimony to ye Accomplishmt of wch you have, by yor Commission, ordr to Convene a Councell of ye ablest Chiruugions, or other knowing persons in such case for ye Exiacon of Eleazer Leveredge, his sufficiency for procreation, or ye deficiency of Rebecka Leveridg, ye reputed wife of Eleazer, by authorizing such grave and skilfull Matrons to Examyn into ye Sufficiency or defect of her nature in Case any should appeare, & to retorne you an Accout thereof wch likewise you are to Transmitt to me, together wth your results & opinions of yor Judgements of ye whole matter committed to yor hearing according to yor Comission & Instructions.
      May ye 6th 1670 Francis Lovelace:

      "A Divorce granted to Rebeckah Wright from Eleazer Leveridg.
      Whereas Nicholas Wright of Oysterbay on ye behalfe of his Daughtr Rebeckah, ye wife of Eleazer Leveridg, & ye said Rebeckah for her selfe, did make their Complaint unto me against ye said Eleazer Leveridg her husband, That she having been his reputed wife for ye space of Seaven yeares & a halfe, She hath not in all that tyme Received any due benevolence from her said husband according to ye true Intention of Matrimonye, the greate end of wch is not onely to extinguish those fleshly desires & appetites incident to Humane nature, but likewise for ye Well ordering & Confiration of ye Right of Meum & Tuum to be devolved upon the Posterity lawfully begotten betwixt man & wife, according to ye Laws of ye Land, & practice of all Christian Nations in that case provided, & did therefore sue for a divorce, whereupon having appointed Comre to call both partyes before them, & strictly to examine into ye affayre & make report of their Judgment, thereupon ye wch after serious inquiry made by them, wth ye Advice of Chirurgions well skill'd, & Sober Matrons, who privily examined both ye man & woman, they made Report of their Judgement, & opinion, that ye defect was in ye husband, & not in ye wife, And that there was sufficient ground for a divorce, All wch being afterwards represented to my Councell, & they having declared themselves to agree to ye Same opinion: For ye Reasons afore specified, ye prtended marriage betweene ye said Eleazer Leveridge, & Rebeckah Wright, is hereby adjudged & declared to be void null and invalid, Togethr wth all ye Consequences thereof, & ye said Rebeckah Wright is hereby acquitted, made free, & divorced from all prtences of marriage or Matrimonial Tyes, & obligations betweene her, & ye said Eleazer, and ye said Rebh, hath likewise free libertye to dispose of her selfe in Lawful marriage wth any othr as if ye tyes & Obligations betweene ye said Eleazer, & her had never beene.
      Given undr my hand, & Sealed wth ye Seale of ye Province, this 22nd day of October in ye 22th yeare of his Majesty Raigne. Annoqz Domini 1670.

      And an order being made the 24 Feb. 1670/1 it was decided that "Eleazor Leverich do pay, or cause to be paid unto Rebecca Wright, from whom he is divorced, the sum of £25, in living cattle, to be apprized by indifferent men, or in corne beef or pork, at price current, in lieu of what she brought him at their marriage."
      ...The originals of these court records, from which the above was taken, were destroyed by fire at the Capitol, at Albany, in 1911, where they had been deposited.
